“Premises liability cases occur when a person is injured by a dangerous condition on someone’s property. This can arise in a variety of contexts. Common examples include, liquid spilled on a grocery store floor, a raised crack in the sidewalk, a step that was not built to code, or an uncovered hole on a construction site.
To pursue a claim we first determine who owned, leased, occupied, or controlled the property. Once we have identified the responsible party, we need to gather evidence to prove that they were negligent in the use or maintenance of the property.
A person who owns, leases, occupies, or controls property is negligent if he or she fails to use reasonable care to keep the property in a safe condition. They must use reasonable care to discover any unsafe conditions and to repair, replace, or give adequate warning of anything that could be reasonably expected to harm others.
In deciding whether a party used reasonable care a jury will consider, among other factors, (a) The location of the property; (b) The likelihood that someone would come onto the property in the same manner as the injured party; (c) The likelihood of harm; (d) The probable seriousness of such harm; (e) Whether the owner knew or should have known of the condition that created the risk of harm; (f) The difficulty of protecting against the risk of such harm; and (g) The extent of the owner’s control over the condition that created the risk of harm.
After we prove negligence, we must then establish that our client was harmed, or in other words, that they suffered an injury.
We then must demonstrate that the owner’s negligence was a substantial factor in causing that harm. Once causation is established we have effectively proven our premises liability case.
However, there are often defenses that are asserted. A common defense is that our client was comparatively negligent for not observing and avoiding the condition.
Another common defense is that the unsafe condition of the property was so obvious that a person could reasonably be expected to observe it. Therefore, the owner did not have a duty to warn others about the dangerous condition.
